1. RESPONSIBILITIES OF GRUPO WISH

  • 1.2.1. If this occurs, the Grupo Wish will use its best efforts to restore access to the site as soon as possible, within the technical limitations of our services and those of third parties on which we depend to remain online.
  • 1.2.2. The Grupo Wish reserves the right to change the rules and criteria established, the types of services provided, the companies responsible for brokering them and anything else it deems necessary for the proper operation of the site.


1.3. You have no right to demand that the Grupo Wish make the site available, nor may you seek compensation or damages if the site remains unavailable, regardless of the reason.


1.4. The Grupo Wish shall not be liable:

  • 1.4.2. 2. YOUR RESPONSIBILITIES

2.1. You are responsible for and undertake to:

  • 2.1.3. Keep your Access Account details confidential, especially your login and password, with respect to third parties, and use it personally and non-transferably. Do not make your password or any authentication mechanism available to, disclose it to or share it with anyone, including on Platforms offered by third parties. If you suspect that your password's confidentiality has been compromised, you must change or update it as soon as possible or contact the available customer service channels.
  • 2.1.4. Acknowledge that all access and operations carried out after your successful digital authentication will be deemed unquestionably to be your responsibility, including those resulting from improper use or disclosure thereof to third parties.

2.2. 3.3. You are solely responsible for receiving communications and notifications, so it is essential that you always provide correct and accurate information and keep it up to date.


4. PROTECTION OF YOUR PERSONAL DATA

4.1. The Grupo Wish has a separate document, called the Privacy Policy, which governs the processing of data collected on the site and forms an integral and inseparable part of these Terms and Conditions of Use.


5. COPYRIGHT AND INTELLECTUAL PROPERTY

5.1. The commercial use of the expression “Grupo Wish”, or of words resembling it but with different spelling, such as trademarks, company names or domain names, as well as the contents of the site's screens, computer programs, databases, networks and files, are owned by or licensed to the Grupo Wish and are protected by laws and international treaties concerning intellectual property, including, but not limited to, Federal Laws 9.609/98, 9.610/98, 9.279/96 and 10.406/2002.


5.2. No element found on the site may be copied, reproduced, modified, republished, uploaded, altered, transmitted or distributed in any way or form, in whole or in part, without the Grupo Wish's prior express authorization.


5.3. By accessing the site, you agree to respect all intellectual property rights of the Grupo Wish, including, but not limited to, computer programs, copyrights and industrial property rights relating to trademarks, logos, patents, domain names, corporate name and industrial designs that may have been filed or registered in the name of the Grupo Wish, as well as all rights relating to third parties that may be or have been made available on the site in any way. Any infringement may result in the blocking of your Access Account at the Grupo Wish's discretion, in addition to making you liable for court-awarded damages.

The Terms and Conditions of Use shall be interpreted under Brazilian law, in Portuguese, and the courts of the District of São Paulo shall have exclusive jurisdiction to resolve any dispute or controversy involving this document, except where applicable law specifically provides otherwise based on personal, territorial or subject-matter jurisdiction.
